ASSUMPTION OF RISK and LIABILITY RELEASE & AGREEMENT
For Fun Pickleball, Inc. (“The Organization”), offers various programmed activities (“Activities” or “Activity”) for participation. This Assumption of Risk and Liability Release & Agreement (Release & Agreement) is designed to release The Organization from liability related to participation in Activities. This Release & Agreement evidences your agreement that The Organization may take photos and recordings of Activities for The Organization’s use. This Release and Agreement also evidences your agreement that if you are rendered unable to request medical treatment for yourself or your minor, give The Organization or its participants permission to seek such treatment on your behalf. Finally, this Release & Agreement gives The Organization permission to use your email address and contact information for other Organization promotions and activities.
This Release & Agreement is designed to be a standing Release, that is, once this Release is signed by you (for yourself or your Minor), it will apply to all Activities for which you register through the Organizations registration systems until this Release is revoked by you or you are notified by the Organization that it needs to be updated or replaced.
In consideration of being allowed to register for and participate in an Activity offered by the Organization, I, the undersigned, on behalf of myself or as parent or legal guardian of a minor (“Minor”), agree to support and conform to Activity rules established by the Organization to provide for the health and safety of participants in Activities. I acknowledge, understand, and agree for myself and Minor, that participation in Activities carries various general risks to participants including risks related to the spread of infectious diseases, property damage, reputational injury, personal injury, or even death.
In signing this form, I, for myself and Minor, release all liability from the Organization, its personnel, participants, and facilities where games or activities occur. I agree to accept all responsibility for any costs or damages resulting from an injury or accident.
I, for myself or as parent or legal guardian of Minor further acknowledge, appreciate, and agree that:
1. I have read this Release & Agreement and carefully reviewed its contents
2. I Knowingly and freely assume all risks associated with activities for which I now register or register for in the future; and
3. I agree to comply with the stated and customary rules, terms, and conditions for activity participation. If I observe or become aware of an unusual hazard during an activity, I will immediately bring such to the attention of The Organization; and
4. In the event that I cannot communicate for myself or for my Minor in an emergency, I hereby give permission to the organization, personnel, facilities, agents, or its participants to seek medical attention on my or my Minors behalf. I also give permission to any licensed physician, surgeon, clinic, or hospital to secure proper treatment and to order anesthesia for me or my Minor; and
5. I, for myself and for Minor, as applicable, and our heirs, assigns, executors, and administrators release, waive, and discharge any legal rights I may have, or that I may assert on behalf of Minor, to seek payment or relief of any kind from the Organization, its officers, personnel, agents, or the facilities being used for injury, illness, reputational damage, or death resulting from participating in an activity. I also agree not to sue the Organization, its officers, personnel, or agents; and
6. The Organization, its personnel, Agents and participants may photograph, video or otherwise record (”Recordings”) activities, participants and those who may observe activities, and may use publish, and broadcast such recordings in the conduct of the organizations business, including promoting the organization and its activities. I acknowledge and agree to the organization making such recordings and waive any right or interest I or my Minor may have to or in such recordings; and
7. I understand that the Organization may use the contact information I provide, including email addresses, social media profiles and phone numbers, to provide me with information, services related to my participation in Activities and to provide me with information regarding other Organization promotions, initiatives, and activities. I further allow “The Organization” to provide third parties with basic demographic information about its participants and non-personally identifiable information as it sees fit; and
8. I understand and intend that this Release & Agreement will remain in effect until it is terminated in writing by me, or the Organization informs me that a new or updated release is required. Minors will be required to sign a new Release & Agreement upon turning 18 years of age. I intend for this Agreement to apply to all Activities for which I, or my Minor, as applicable, register.
9. I agree that if any provision of this Release & Agreement is held to be illegal or invalid by a court of competent jurisdiction, such provision shall be considered severed and deleted and such severance shall not affect the validity of the remaining provisions of this Release & Agreement.
10. I agree that my electronic execution of this Agreement shall be as valid as my original, manual signature and shall be effective to bind me to this Release & Agreement; and
11. I agree that in my participation in activities, social media and other interactions with the organization, its personnel, agents, and facilities, I will act in a calm, respectful and inclusive manner. I further agree to abide by the terms of the Organization Code of Conduct published on its website.
I HAVE READ THIS RELEASE & AGREEMENT, FULLY UNDERSTAND ITS TERMS AND HAVE SATISFIED MYSELF AS TO QUESTIONS I MAY HAVE, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY. I CONFIRM THAT I OR MY MINOR AM/IS FIT PHYSICALLY AND OTHERWISE ABLE TO PARTICIPATE IN SUCH ACTIVITIES AS I MAY REGISTER FOR AND THAT I WISH FOR MYSELF/MY MINOR TO PARTICIPATE UNDER THE TERMS OF THIS AGREEMENT IN ALL ACTIVITIES FOR WHICH I REGISTER.
Code of Conduct
BE ON TIME
Please be respectful of the Organizers’ and your fellow participants’ time. Everyone’s time is valuable. If something comes up, please make a concerted effort to notify the host or participants so they can manage accordingly.
DON’T “NO SHOW”
Please be respectful of others’ enjoyment in activities and events. In the event that your plans change, or an urgency alters your plans, please notify as early as possible so that a substitute or workaround can be implemented.
RESPECT YOUR FELLOW PARTICIPANTS
There is no place for violence or disrespect between participants. It is encouraged that everyone participates and feels comfortable and confident. This will only be a result of respect and care. Respect includes listening to each member’s opinions and comments, inclusion and simply being kind to one another. Harassment of any participant will not be tolerated.
RESPECT STAFF MEMBERS
The Organizers, event staff, volunteers are here for your enjoyment and to promote the spirit of fun. If you disagree with directions, rulings, procedures, please mention it in a constructive and respectful manner.
RESPECT THE ENVIRONMENT
As some games will be hosted in facilities or outdoor locations, it is critical your players are reminded to respect the space they are in. There will be no tolerance for damaging fields, courts or any equipment that is at venues.
FOLLOW THE RULES OF THE GAME
For Fun Pickle uses the USAPA Rules of the game as currently published at the time of an event. The rules can be found at USA Pickleball Official Rulebook and Rules Summary.
MAINTAINING SPORTSMANSHIP
Play fairly, stay positive and enjoy the activity, win or lose. Nobody enjoys playing with a sore sport or a constant complainer. Remember, we’re here to have fun!

Please remember that all of us are ambassadors for the game, the organization and each other. Your positive comments and support will help bring new, fun people to the group and expand our options for programming.
